1. Acceptance of Terms
By accessing or using "The Atlas" ("Service", "we", "us", or "our"), you agree to be bound by these Terms of Use ("Terms"). If you disagree with any part of the terms, then you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.
Age Limitation: The Service is not intended for individuals under the age of 16. By creating an account, you affirm that you are at least 16 years old. If you are under 18, you affirm that you have parent or guardian permission to use the Service. We do not knowingly collect data from children. If we discover a user is under 16, we will immediately delete the account and all associated data.
2. Beta Service Disclaimer
Please note that the Service is currently in BETA. The Service is provided "AS IS" and "AS AVAILABLE" without any warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
We do not guarantee that the Service will be stable, uninterrupted, error-free, secure, or reliable. You acknowledge that using the Service may result in unexpected behavior, data loss, or service interruptions. We reserve the right to modify, suspend, or discontinue the Service at any time without prior notice.
3. Accounts and Access
To access the Service, you must register for an account using a valid email address. We verify identities via One-Time Password (OTP) sent to your email.
- You are responsible for safeguarding the credentials used to access the Service and for any activities or actions under your account.
- You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
- You must provide accurate, current, and complete information during the registration process and keep your account information updated.
- We reserve the strict right to limit the number of accounts created by a single individual or entity. Attempts to bypass these limits (e.g., via VPNs, incognito browsing, browser fingerprint spoofing, or disposable emails) constitutes a material breach of these Terms and will result in immediate account termination.
- You may not use another user's account without permission.
4. Usage Restrictions and Anti-Abuse
You agree not to engage in any of the following prohibited activities:
- Scraping: Using any automated system, including without limitation "robots," "spiders," "crawlers," or "offline readers," to access the Service in a manner that sends more request messages to the servers than a human can reasonably produce in the same period of time by using a conventional web browser.
- Reverse Engineering: Attempting to reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code, object code, or underlying structure, ideas, or algorithms of any portion of the Service or its database structures.
- Interference: Attempting to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the Service.
- Circumvention: Attempting to circumvent any security measures, rate limits, access controls, or anti-abuse systems implemented by the Service.
- Misrepresentation: Impersonating another person or entity, or falsely stating or otherwise misrepresenting your affiliation with a person or entity.
- Commercial Use: Using the Service or any content therein for any commercial purpose without our express written consent.
- Harmful Content: Uploading, transmitting, or distributing any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
Account Termination: We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease. All provisions of the Terms which by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
5. Intellectual Property Rights
The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of The Atlas and its licensors. The Service is protected by copyright, trademark, and other laws of both Germany and foreign countries.
Specifically, the proprietary structure of the chess opening database, the analysis algorithms, the aggregated statistical data, and all visual designs and user interface elements are protected intellectual property. You may not copy, modify, distribute, sell, lease, sublicense, or create derivative works from any part of our Service or included data without our explicit written permission.
6. User Content
If you submit any content to the Service (including but not limited to support tickets, feedback, or feature requests), you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in any media.
You represent and warrant that you own or have the necessary rights to submit such content and that the content does not violate any third party's rights.
7. Third-Party Links and Services
The Service may contain links to third-party websites or services that are not owned or controlled by The Atlas. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.
You acknowledge and agree that The Atlas shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.
8. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall The Atlas, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of or inability to access or use the Service;
- Any conduct or content of any third party on the Service;
- Any content obtained from the Service;
- Unauthorized access, use or alteration of your transmissions or content;
- Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Service;
- Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Service.
This limitation applies whether based on warranty, contract, tort (including negligence), strict liability, or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
9. Indemnification
You agree to defend, indemnify, and hold harmless The Atlas and its licensors, employees, contractors, agents, officers, and directors from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of: (a) your use and access of the Service; (b) your violation of any term of these Terms; (c) your violation of any third party right, including without limitation any copyright, property, or privacy right; or (d) any claim that your use of the Service caused damage to a third party.
10. Dispute Resolution
Any dispute arising out of or in connection with these Terms, including any question regarding its existence, validity, or termination, shall first be attempted to be resolved through good-faith negotiation between the parties. If the dispute cannot be resolved through negotiation within 30 days, either party may pursue formal legal action in accordance with the Governing Law section below.
11. Support and Contact
If you experience issues with the Service or have questions regarding these Terms, you may submit a support ticket through our website at /support. We aim to respond to all inquiries within 48 business hours. Support is provided on a best-effort basis and does not constitute any guarantee of resolution.
12. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect (where practical). What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
13. Severability
If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.
14. Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of The Atlas.
15. Assignment
You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. Any attempt by you to assign or transfer these Terms without such consent will be null and of no effect. We may assign or transfer these Terms, at our sole discretion, without restriction.
16. Entire Agreement
These Terms, together with the Privacy Policy and any other legal notices published by us on the Service, constitute the entire agreement between you and The Atlas regarding our Service, and supersede and replace any prior agreements we might have had between us regarding the Service.
17. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions.
Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Germany. You waive any objections based on lack of personal jurisdiction, place of residence, improper venue, or forum non conveniens in any such action.
18. Force Majeure
The Atlas shall not be liable for any failure or delay in performing its obligations under these Terms if such failure or delay results from circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
